The implications of different tests for "Product of" under Australia's new Country of Origin law: Is it easier to claim "Product of France" than "Product of Australia?"

It is clear that a goal of the new Country of Origin Food Labelling Information Standard is to assist consumers in identifying how “Australian” certain categories of food product are. However, in distinguishing labelling obligations for products packed in Australia versus products packed outside of Australia, the new Information Standard may have inadvertently created two different legal definitions of “product of” claims. Perhaps more importantly for the Australian industry, many food products that previously claimed to be “Product of Australia” may no longer be able to do so after 1 July 2018.
